KINGSTON — The Kingston Conservation Commission approved a revised stormwater and fencing plan at 53R Main Street and confirmed $1,200 in daily fines continue at an unresolved 6 Prospect Street enforcement case. Commissioners voted 5-0 to issue a negative determination of applicability for 53R Main Street, represented by Laura Begay of Green Seal Environmental, after the applicant removed unpermitted pavement in favor of pervious stone. The Conservation Agent told the board "what I see today is a wetland" regarding unpermitted retaining walls built near an unmapped vernal pool at 10 Innsbruck Lane, continued to August 5 while owners Kurt and Jen Johnson work with wetland scientist Brad Holmes on a restoration plan.
At 6 Prospect Street, $300-per-violation fines across four violations total $1,200 daily, with one unpaid batch reaching roughly $10,000; the agent said "we want a quick solution on this because there is risk there." The commission closed an enforcement order at 1 North Street and continued cases at 44 Rabbit Road and 19 Blair Drive.
