Kingston Water Commission Flags Capacity Rights, Payment Terms in Miramar Sewer Deal
Kingston Water Commission challenges key terms in Miramar sewer agreement, pressing for higher upfront payment.
Water · Meeting of March 24, 2026
Kingston Water Commission challenges key terms in Miramar sewer agreement, pressing for higher upfront payment. The board spent most of its March 24 session reviewing a draft inter-municipal sewer contract with the Miramar residential development in Duxbury, which would connect to Kingston's system and generate between $2.5 million and $3.5 million in upfront access fees. Commissioner Brian led a section-by-section critique, arguing the contract's 50 percent unrestricted payment offer should be restored to the 75 percent the developer originally proposed, and warning that language defining "allocated capacity" at 44,000 gallons per day must not be read as a grant of that daily flow, actual expected use is closer to 22,000 to 23,000 gallons.
The board also asserted that Kingston, not the developer, must retain sole authority over any unused sewer capacity. The commission unanimously approved a $998.40 corrected billing charge for 15 quarters of estimated usage at 12 Curtis Avenue, and submitted three placeholder town meeting warrant articles including a $137,753 request for the town to cover one-third of leaching field debt service.
