Kingston Board of Health orders fresh Title 5 testing, issues enforcement order in a divorce-stalled septic case. Meeting with only three members present, the board directed the new owner of a 106 Allen Street property to complete a full Title 5 inspection, including a camera scope and an as-built plan showing the septic system's setback from the home's well, after he said he has invested more than $300,000 in the house and found no sign of the failure the town flagged. In a second hearing, a homeowner described a septic system in failure for roughly four years that she cannot repair because her estranged husband, a co-owner, will not sign the paperwork for a town betterment loan.
"They're contacting him. He's not responding. He's not cooperating," she said.
The board voted unanimously to issue a formal enforcement order she can bring to probate court and continued her case to a future meeting.
